Burkina Faso: A draft law amending the Mining Code under consideration

The transitional government in Burkina Faso says it examined, on Wednesday in the Council of Ministers, a bill amending the Mining Code.

This amendment, to Law No. 36-2015/CNT of June 26, 2015 on the Mining Code of Burkina Faso, introduces provisions allowing part of the resources of the Mining Fund for Local Development (FMDL) to be donated to the Patriotic Support Fund (FSP ).

The authorities explain that these resources will help restore and strengthen security throughout Burkina Faso and provide an urgent, effective and efficient response to the humanitarian crisis in Burkina Faso.

The Council marked its agreement for the transmission of the said bill to the Transitional Legislative Assembly.

As a reminder, this code governs, according to its article 2, “all operations relating to prospecting, research, exploitation of deposits of mineral substances as well as treatment, transport, transformation, the marketing and saving of mineral substances, excluding water and liquid and gaseous hydrocarbons. It also governs all operations for the rehabilitation and closure of mining and quarrying sites”.

Last January, the authorities had justified the launch of the FSP by the need to provide the government with a unique instrument for the collection and transparent and efficient management of financial contributions in order to support efforts to defend and secure the national territory. .

The resources of this Fund are made up of voluntary financial contributions from natural and legal persons residing in Burkina and from the diaspora, technical and financial partners; donations and legacies. They are used to finance the expenses of the Volunteers for the Defense of the Fatherland (VDP, civilian auxiliaries of the army), namely salaries, equipment expenses and fuel.
